Welcome to our online store. These Terms of Service ("Terms") govern your access to and use of our website, products, and services. By accessing our website, purchasing our digital products (Lightroom presets, PDFs etc), or buying our physical goods (zines, books, photo prints etc), you agree to be bound by these Terms.

Please read them carefully before making a purchase. If you do not agree to all of these Terms, you may not access the website or purchase our products.

2. Intellectual Property & Digital Usage Licenses

A. Intellectual Property Ownership

All digital and physical items available on this website—including but not limited to Lightroom presets, PDFs, books, zines, layout designs, photographic images, text, logos, and graphics—are the exclusive intellectual property of Spyros Panos and are protected by international copyright, trademark, and intellectual property laws. You are strictly prohibited from reproducing, distributing, modifying, or copying any content without the express written consent of the author.

B. Lightroom Presets (Digital Download License)

When you purchase Lightroom presets from this website, you are not buying the source files or the copyright. Instead, you are granted a single-user, non-exclusive, non-transferable, revocable license for personal and professional photographic editing use.

  • Prohibited Uses: You may not share, rent, lease, lend, sell, redistribute, relicense, re-package, or sub-license the preset files (.xmp, .dng, etc.) to any third party. Modifying the presets and reselling them as your own creation is strictly prohibited and constitutes copyright infringement.

C. Physical Publications & Prints (Books, Zines, Photo Art)

Purchasing a physical book, zine, or photo print grants you ownership of that specific tangible object.

  • Prohibited Uses: You do not acquire any reproduction rights. You are strictly prohibited from scanning, digitally reproducing, copying, or commercially distributing any photographs or text contained within our publications or art prints without express written consent from the author.

3. Pricing, Payments, & Tax (VAT) Structures

A. Currency & Price Adjustments

All prices are displayed in Euros (€) unless stated otherwise. We reserve the right to modify prices for any products or services at any time without prior notice.

B. Dutch Small Business Scheme (KOR) Notice

Our company is registered under the Dutch Small Business Scheme (Kleineondernemersregeling - KOR).

  • Dutch Customers (NL): In compliance with Article 25 of the Dutch Wet OB, invoices to customers located in the Netherlands are exempt from Dutch Turnover Tax (BTW). No VAT is charged.

  • International Customers (EU & Non-EU): Digital and physical goods exported or supplied internationally are processed outside the scope of local Dutch VAT or are subject to international cross-border e-commerce tax laws based on destination thresholds.

C. International Customs, Import Duties, & Local Taxes

For all physical orders shipped outside the European Union (including but not limited to the United Kingdom, United States, and Asia):

  • Buyer’s Responsibility: The buyer is solely responsible for paying any import duties, customs clearance fees, brokerage fees, or local sales taxes levied by the destination country's customs authorities. These fees are collected at the border and are not included in the purchase price or shipping fees at checkout.

  • Refusal to Pay Customs: If a package is abandoned at customs or returned to us because the buyer refuses to pay local import taxes, refunds will be managed strictly according to our Refund Policy (freight penalties and return shipping costs will be deducted from any final payout).

4. Shipping, Production, & Delivery Dynamics

A. Digital Delivery

Digital products (Lightroom presets, PDFs etc) are delivered instantly via automated download links sent to the email address provided by the customer at checkout. Delivery is deemed complete when the email or download link is successfully transmitted.

B. Physical Delivery & Print-on-Demand Production

  • Limited Batch Inventory (Zines/Books): Orders for in-stock inventory are typically processed and shipped from Amsterdam within 2–4 business days.

  • Print-on-Demand Items (Custom Photo Prints): These items are made-to-order individually. Please allow a manufacturing window of 3–7 business days before your item is dispatched.

  • Delays: Delivery timeframes provided at checkout are estimates only. We are not liable for transit delays caused by customs processing, postal carrier strikes, or international shipping bottlenecks.

5. Return, Cancellation, & Refund Summary

All refund, return, and cancellation procedures are governed strictly by our separate Refund & Return Policy, which is incorporated into these Terms by reference. This includes:

  • An immediate waiver of the 14-day cooling-off period upon downloading digital presets.

  • A 14-day statutory return window for batch-printed physical zines (where the customer bears the cost of return shipping).

  • An explicit return exemption for customized, made-to-order print-on-demand photo prints.

6. Limitation of Liability & Disclaimers

A. Digital Product Performance Disclaimer

Our Lightroom presets are designed to enhance photographic imagery based on standard professional editing environments. Because every photograph features distinct lighting, camera sensors, color balances, and exposures, we do not guarantee that the presets will achieve a perfect result on every photo upon a single click. Manual adjustments may be required by the user.

B. Technical Disclaimer

We do not guarantee that our website checkout or digital file delivery systems will be 100% uninterrupted, timely, secure, or error-free. To the maximum extent permitted by Dutch law, Spyros Panos shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our products or website.

7. Governing Law & Dispute Resolution

These Terms and any separate purchase agreements shall be governed by and construed in accordance with the laws of the Netherlands.

  • Any disputes arising out of or in connection with these Terms that cannot be settled amicably shall be submitted exclusively to the competent court in Amsterdam, The Netherlands.

  • EU Consumers may also utilize the European Commission’s Online Dispute Resolution (ODR) platform to settle disputes out of court.

Return / Refund Policy

1. Digital Products (Lightroom Presets, PDFs)

Due to the digital nature of Lightroom presets, PDFs etc all sales of downloadable content are final and non-refundable. By purchasing, you expressly agree to receive immediate access to the files, thereby waiving your statutory 14-day right of withdrawal under EU/UK consumer law. That effectively means that returns or refunds are not possible for such products.

2. Physical Books & Zines (Limited Batch Inventory)

For our physical, in-stock publications (such as limited-run zines and books), customers residing in the EU, EEA, and UK have the statutory right to change their mind and cancel their purchase within 14 calendar days from the day the package is delivered.

  • Return Process: You must notify us via email within this 14-day window to initiate a return. Do not mail items back without contacting us first.

  • Return Shipping Costs: The customer is solely responsible for paying all return shipping fees. We highly recommend using a trackable shipping service with proof of postage, as we cannot issue a refund for items lost or damaged by the postal carrier during transit back to the Netherlands.

  • Item Condition: To qualify for a full refund, the item must be returned completely unused, unread, undamaged, and in its original pristine packaging. If an item is returned in a condition that reduces its resale value, a deduction will be made from your refund.


3. Print-on-Demand Products (Photo Prints & Made-to-Order Items)

Our large-format photo prints, custom wall art, and specific made-to-order merchandise are manufactured individually only after you place your order.

  • No Right of Withdrawal: In accordance with Article 16(c) of the EU Consumer Rights Directive, custom-made and clearly personalized items are exempt from the standard 14-day cooling-off period. We cannot accept returns, cancellations, or exchanges for print-on-demand products if you change your mind, decide you don't like the formatting, or select the wrong size.


4. Damaged, Defective, or Incorrect Items (All Physical Goods)

Your satisfaction and the quality of our physical products are incredibly important. If any physical item (whether a batch-printed zine or a print-on-demand photo print) arrives damaged, or features a legitimate manufacturing defect (such as a severe misprint or binding error):

  • Please contact us at within 14 days of delivery.

  • Include your order number and clear photographic evidence of the damage or defect.

  • Once verified, we will gladly arrange for a free replacement reprint or a full refund.
